Terms of Use

Last updated

These terms cover the Louyia mobile app and this website. They are written to be understood rather than to sound impressive, and they try to be honest about what Louyia can and cannot promise.

Agreeing to these terms

These terms are an agreement between you and Louyia. By creating a Louyia account or using the app, you agree to them. If you do not agree, please do not use Louyia.

Our Privacy Policy explains what information Louyia handles and forms part of this agreement.

Louyia is the tool, not the service

Louyia records loyalty cards, stamps and appointments for independent local businesses. The businesses themselves decide what they offer, provide the service you book, and give the reward they promised. Louyia is not a party to that arrangement and does not perform it.

Who can use Louyia

You must be at least 13 years old, or older if the country you live in requires it, and you must be able to enter into a binding agreement. If you use Louyia on behalf of a business, you confirm that you are authorised to accept these terms for that business.

You may not use Louyia if you are barred from doing so under the laws that apply to you, or where use of the App Store is prohibited.

Your Louyia account

Louyia accounts are created inside the mobile app using Sign in with Apple or Sign in with Google. There is no Louyia password and no account on this website.

  • One sign-in identity belongs to one Louyia account, of one type — Customer or Business.
  • Keep control of the Apple or Google account you sign in with. Anyone who controls it can reach your Louyia account.
  • You are responsible for what happens under your account, and for the accuracy of what you put into it.

If you use Louyia as a customer

You join a business by scanning its code or entering the invite code it gives you. Once you have joined, that business can add stamps to your card and can see your progress with it.

  • The business sets the rules of its own program — the reward, how many stamps it takes, and whether the offer continues.
  • Stamps and rewards have no cash value, cannot be exchanged for money, and cannot be transferred between people or between businesses.
  • You pay the business, not Louyia. Louyia does not take payment for a service you book or for anything you buy in a shop.

If you use Louyia as a business

You are responsible for the program you run and the service you provide. In particular, you agree that:

  • You will honour the rewards you offer on the terms you have shown to your clients through Louyia.
  • You will keep your details accurate — your business name, services, prices, hours, address and policies — because your clients rely on them.
  • You will only give stamps for genuine visits and will not use Louyia to fabricate activity.
  • You will handle your clients’ information properly. The client details Louyia shows you are for running your own relationship with those clients. Do not use them for anything else, do not sell them, and comply with the data protection law that applies to you.
  • You are responsible for your own business obligations — licences, insurance, taxes, health and safety, consumer law, and anything else your trade requires.
  • You will only publish content you are entitled to publish on your public profile and portfolio.

Loyalty programs and rewards

A loyalty program in Louyia belongs to the business that created it. Louyia records stamps and shows progress, and does not promise on any business’s behalf that a reward will be given.

A business may change or end its program. Where that happens, we expect it to deal fairly with cards already in progress, but the arrangement is between the customer and that business. If something goes wrong, speak to the business first; you can also email us and we will look into misuse of Louyia.

Rewards are provided by the business, at the business’s cost, and have no monetary value.

Appointments

Where a business takes appointments through Louyia, booking creates an arrangement between you and that business. Louyia passes on the request, records the time and tells each side what changed.

  • A business can confirm, decline, reschedule or cancel a booking, and may set its own cancellation or lateness policy, which you will be shown.
  • Prices and durations shown at the time of booking come from the business. Payment happens at the business — Louyia does not process it.
  • Louyia does not guarantee that a business will accept a request, will be open at the time booked, or will perform the service.

Business subscriptions

Customer accounts are free. Some Business features require a paid subscription, which is purchased through your Apple ID in the App Store.

  • Apple takes the payment, and the price, currency and billing period shown at purchase are the ones that apply.
  • A subscription renews automatically until you cancel it. Cancel at least 24 hours before the period ends to avoid the next charge.
  • You manage and cancel it in your Apple ID settings, not in Louyia. Louyia cannot cancel a subscription for you.
  • Refunds are handled by Apple under Apple’s own policies. This does not affect any refund right you have under the consumer law where you live.
  • Deleting your Louyia account does not cancel your subscription. Cancel it with Apple separately, or you may continue to be billed.

If a subscription lapses, paid Business features stop being available. We will not delete your business or its data because a subscription ended.

The App Store and Apple

Louyia is distributed through Apple’s App Store. The following applies to your use of the app on an Apple device.

  • This agreement is between you and Louyia only. Apple is not a party to it, and Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
  • If a third party claims the app infringes their intellectual property rights, Louyia, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Content you provide

Your content stays yours. That includes your business name and description, your logo, your portfolio photos, your services and your policies.

So that Louyia can show it to the people you intend to see it, you give Louyia permission to store, reproduce and display that content within the Louyia app and its services. This permission exists only to run Louyia, does not let us sell your content or use it to advertise, and ends when you remove the content or delete your account — except for copies that remain in routine backups for a limited time.

You confirm that you have the rights to the content you upload, including permission from anyone identifiable in a photograph.

Louyia’s own intellectual property

The Louyia app, this website, the Louyia name and the Louyia design belong to Louyia. You may use the app as these terms allow; you may not copy, resell, reverse engineer or build a competing service out of it, except where the law expressly permits you to.

Acceptable use

You agree not to:

  • Use Louyia to break the law, to harass or defraud anyone, or to publish content that is illegal, hateful, sexually explicit or deceptive.
  • Impersonate another person or business, or claim a business you are not entitled to run.
  • Award, redeem or claim stamps and rewards dishonestly, or try to work around the limits of a program.
  • Try to reach accounts, data or parts of the service that are not yours, or to probe, scan or overload the service.
  • Use automated means to access Louyia, or to collect information about other users or businesses.
  • Interfere with anyone else’s use of Louyia.

If you find a security problem in Louyia, please tell us at help.louyia@gmail.com before telling anyone else.

Availability and changes

Louyia is a growing product. Features may be added, changed or withdrawn, and the service may be unavailable at times — for maintenance, because of a problem, or because something a provider runs has failed.

We do not promise that Louyia will be uninterrupted or error free. Where a change removes something a paying business relies on, we will give reasonable notice.

Third-party services

Louyia works alongside services run by other companies — Apple and Google for sign-in, Apple for purchases, and the providers listed in our Privacy Policy. Their own terms apply to what they do, and Louyia is not responsible for them.

Where a business links to its own page elsewhere, that page is not ours and we do not control what is on it.

Ending your use of Louyia

You can stop using Louyia at any time, and you can delete your account from Profile → Delete Account inside the app. Deletion is immediate and cannot be undone. Remember to cancel any Apple subscription separately.

We may suspend or close an account that breaks these terms, that is being used to defraud customers or businesses, or where we are required to by law. Where it is reasonable to do so, we will tell you why and give you a chance to put it right.

Disclaimers

Louyia is provided as it is. To the extent the law allows, we do not give warranties that the service will meet your requirements, be uninterrupted, or be free of errors.

We do not vet the businesses that use Louyia, and we do not guarantee the quality, safety, legality or availability of what a business offers, nor that a business will honour a reward or keep an appointment. Those are the business’s responsibility.

Nothing here removes rights that cannot be removed under the law where you live. If you are a consumer, you keep your statutory rights in full.

Limits on liability

To the extent the law allows, Louyia is not liable for indirect or consequential loss, for lost profits or lost business, or for loss arising from a business failing to honour a reward or an appointment booked through Louyia.

Any liability Louyia does have is limited to the maximum extent permitted by the law that applies to you. We do not state a fixed figure here: how far liability may lawfully be limited differs from one country to another, and naming an amount that does not hold where you live would tell you less than saying so plainly.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Some countries do not allow the exclusions above, in which case they do not apply to you.

Changes to these terms

We may update these terms as Louyia changes. The date at the top shows when they were last updated. If a change matters to you, we will make it clear in the app rather than relying on you to re-read this page. Continuing to use Louyia after a change means you accept the updated terms.

Governing law and disputes

If something goes wrong, please email us first — almost everything is settled faster that way than through a formal process.

Nothing in these terms takes away rights you have under the mandatory consumer law of the country you live in, including any right to bring proceedings in your local courts or to rely on that country’s law.
